TERMS AND CONDITIONS

  1. All sums shall be paid in Hong Kong Dollars net of any bank fees or charges (if any). Only cash, cheque, FPS, Payme, bank transfer, and wire transfer payments are accepted.
     

  2. MR. PHOTOBOOTH HONG KONG (the “Company”) shall at all times have the right to require the Customer to pay a deposit and/or to make an advance payment at such amount as determined by the Company at its sole discretion for the Services. Any deposit and/or advance payment, if required by the Company, shall be payable on or before the due date as specified in the invoice. The balance of service fees shall be payable on the date of provision of the Services.
     

  3. The due date for payment will be stated in the invoice. A handling fee of 3% of the total amount payable in the invoice will be charged per calendar day for any late payments received after the due date.
     

  4. Any and all prop(s) and/or background decoration(s) (the “Materials”) provided by the Company at the service venue are the property of the Company and shall not be removed without the prior written authorization of the Company. The Company reserves the right to seek full indemnity from the Customer for any loss of and/or damage to the Materials.
     

  5. The Customer shall be responsible for the stable supply of electricity at 220V AC. Should there be any interruption to the supply of electricity at the service venue rendering the Company to be unable to provide any or all of the Services, the Company shall not be held liable and no refund shall be made. The Company reserves the right to seek full indemnity from the Customer for any damage caused to the Company’s property as a result of any failure and/or problem in the supply of electricity in the service venue.
     

  6. The Customer agrees to take all reasonable steps to protect the photobooth(s), prop(s), backdrop(s), and all other property of the Company against any theft, loss, or damage.
     

  7. To ensure that the Customer can enjoy our service safely, the Company will explain to the Customer the major potential risk(s) and/or accident(s) that may occur in case of misuse of the photobooth(s) and/or other equipment or facilities by the users. By signing on this quotation, the Customer hereby confirm its understanding of all potential risk(s) and/or accident(s) and undertake to inform all users of all photobooth(s) and/or other equipment or facilities provided by the Company of such risk(s) and/or accident(s).
     

  8. The Company shall at all times have the right to prohibit any person from using the Company's service and/or entering the service venue. The Company shall not be liable and the Customer shall be responsible for any harm and/or damage caused to any person and/or property by any person other than staff of the Company.
     

  9. Any request for reschedule or cancellation of service must be provided in writing to the Company at least 7 calendar days before the date of service. The Company reserves the right to charge an additional handling fee of HK$3,000 for any request for reschedule received after the said period. No request for cancellation is accepted within 7 calendar days before the date of service and all balance shall be paid in full immediately. Any and all deposit and/or advance payment made shall be non-refundable in all circumstances.
     

  10. No service will be provided on any day on which a tropical cyclone warning signal no. 8 or above is issued or remains issued in Hong Kong within 3 hours before the scheduled service time or on which a “black rainstorm” warning signal is issued or remains issued in Hong Kong within 3 hours before the scheduled service time. All service postponement request due to bad weather shall be made in writing by the Customer at least 3 hours before the scheduled service time and no service postponement request will be accepted afterwards. No service fee will be charged for the first service postponement due to bad weather. Any service postponement request made on a ground other than bad weather as set out in this paragraph 10 shall be dealt with in accordance with paragraph 9 above. Upon giving service postponement request to the Company, the Customer shall provide the desired rescheduled date and time to the Company within 30 calendar days after the original date of service for confirmation. The Company do not warrant that the desired rescheduled date and time as proposed by the Customer will be available.
     

  11. The Company assumes no responsibility to retain any photo(s) and/or video(s) upon delivery of the same to the Customer. All photo(s) and/or video(s) and email addresses collected by the Company will be permanently destroyed and deleted within 3 month upon the Customer’s full settlement of the invoice.
     

  12. All personal data collected by the Company will only be used for the proper delivery of service to the Customer.
     

  13. The Customer understands and consents that the Company may use the Customer’s name, logo and the photo(s) and/or video(s) taken in the course of provision of the services for the Company’s promotional purposes. Any withdrawal of consent shall be made in writing to the Company.
     

  14. We own the copyright and all other intellectual property rights in everything we create in connection with the Services. The Customer warrants that the Company’s use of any image, sounds, videos, documents and/or objects provided by the Customer for the provision of the Services will not infringe any other person’s intellectual property rights.
     

  15. The Company shall not be responsible for any loss and/or damage caused to the Customers or service venue unless the same is caused by the gross negligence of the part of the Company. The maximum aggregate liability of the Company for claims in relation to the provision of the Services shall not in aggregate exceed the amount payable under this quotation and shall be limited to the actual direct losses and damages suffered by the Customer.
     

  16. The Company reserves the right to amend these Terms and Conditions at any time.
